A significant decision has been handed down by the court who is presiding over the litigation between Dominion Voting Systems and Fox News Corporation, which is valued at $1.6 billion. A judge in Delaware has ordered that Dominion can force Rupert Murdoch and his son Lachlan to take the witness stand in court at a defamation trial later this month.

This information was obtained from Axios. According to the report by the site, the verdict is a huge setback for Fox News. The network had been attempting to convince the judge not to compel the elder Murdoch, who serves as chair of Fox News parent Fox Corp., to testify in person. However, the judge ruled against them.

In order for Dominion to prevail in this legal action, it will be necessary to demonstrate that Fox News intentionally spread misleading material. Fox, on the other hand, has maintained that the firm is shielded by the First Amendment and that it has a constitutional right to investigate stories and cover the news.

According to Axios, the fact that there is a very high bar in being able to prove that Fox behaved with actual malice is because of the First Amendment, which provides significant protections for the news media and makes it very difficult to prove that Fox acted with ‘real malice.

Dominion plainly wants to continue generating deceptive tales from their allies in the media in order to divert attention from the fact that they have a weak case, according to a spokesperson for Fox News who talked to the station. Their political crusade in quest of a financial bonanza has led them to demand witnesses who had nothing to do with the challenged broadcasts.

During that time period, the network issued a statement in which it claimed that Dominion’s lawsuit has always been more concerned with what will garner headlines than with what can hold up under legal and factual scrutiny. The United States Supreme Court made the decision in June that it will not consider a lawsuit that suggested Dominion Voting Systems and Facebook had an improper influence on the 2020 elections. The complaint involved allegations that both companies manipulated votes.

According to Law & Crime, the Supreme Court did not provide any explanation as to why it decided to dismiss the appeal filed by eight Americans led by Kevin O’Rourke after they had been unsuccessful in court on two prior occasions.

The complaint is predicated on a premise that asserts Dominion’s voting software enabled the manipulation of hundreds of thousands of votes during the election in 2020 owing to extensive vulnerabilities.

This theory forms the basis of the claim. Additionally, the lawsuit asserts that Dominion’s voting systems were intentionally and purposefully designed with inherent errors to create systemic fraud and influence election results.
