Robert Kennedy Jr.’s case against the Biden administration can move forward, according to a federal judge’s decision. Kennedy Jr. claims social media platforms were used to restrict his NGO, Children’s Health Defense (CHD), which poses questions regarding the safety of vaccines.

U.S. District Judge Terry Doughty in Louisiana stated that Kennedy has a strong chance of proving that the government’s actions led to the suppression of CHD’s content and that there is a significant possibility he may face similar censorship in the future.

The lawsuit claims that the government exerted pressure on major social media companies, including Facebook, X, and YouTube, to remove content deemed false. Kennedy founded Children’s Health Defense to combat harmful exposures and prevent health crises among children.

Despite criticism labeling the organization as anti-vaccine, the U.S. Centers for Disease Control and Prevention insists that vaccines, including the COVID-19 vaccine, are safe and effective, as reported by Fox News.

Kim Rosenberg, CHD’s general counsel, praised Judge Doughty’s ruling, noting that he carefully applied the legal framework from the U.S. Supreme Court’s recent Murthy v. Missouri decision regarding standing. Rosenberg highlighted that the court ruled decisively in favor of the plaintiffs, affirming that they had properly raised direct censorship claims.

The Murthy v. Missouri case, filed by Republican attorneys general from Missouri and Louisiana, alleged that the Biden administration pressured social media companies to censor specific content. While a Louisiana court initially barred communication between the government and these companies, the U.S. Supreme Court ruled in June, by a 6-3 vote, that the plaintiffs could not demonstrate direct injury or a clear link between the censorship and government actions. The ruling also upheld the companies’ right to manage their content.

Justice Amy Coney Barrett, writing for the majority, concluded that social media platforms have independent reasons for moderating content and often exercise their discretion in doing so. Chief Justice John Roberts and Justices Brett Kavanaugh, Elena Kagan, Sonia Sotomayor, and Ketanji Brown Jackson joined in the decision, denying the plaintiffs a favorable ruling.

However, in Kennedy’s case, Judge Doughty found concrete evidence linking the government’s actions to the censorship of CHD’s content. Kennedy, along with other notable former Democrats, is now poised to help former President Donald Trump build a broader coalition aimed at defeating Vice President Kamala Harris in the upcoming election.

Elon Musk, former Representative Tulsi Gabbard, and Senator Kennedy, all of whom were once aligned with the Democratic Party, have thrown their support behind Trump in this election cycle, which could help attract disillusioned Democratic voters.

Reflecting on his political journey, Kennedy recalled attending his first Democratic Convention in 1960 at the age of six, alongside his father, Robert Sr., and uncle, John, who were prominent Democratic figures. He reminisced about the Democratic Party’s historical stance against censorship, tyranny, imperialism, colonialism, and unjust wars, as well as its commitment to the Constitution and civil rights.

Kennedy also noted that the Democratic Party once championed the working class, government transparency, and environmental protection, standing as a defense against corporate power. He made these remarks during a nationally televised press conference on Friday, where he announced the suspension of his independent presidential campaign and endorsed Donald Trump.
